Annotation: Based on the analysis of historical documents, it is argued that the legislation of pre-revolutionary Russia of the later period that governed relations with respect to possession was largely borrowed from Roman law, the civil doctrine of that time and law enforcement practice proceeded, on the one hand, from the inseparable link between the ownership institution and the institution of property rights ; on the other hand, from the extreme importance and independence of the institution of ownership in relation to the right of ownership.
Keywords: civil law, civil legal relationship, petit protection, possession, property institute, property right
