Annotation: The article is devoted to the unification of the Institute of evidence and proof in civil law (civil and arbitration) process. This paper discusses the appropriate section of the Concept of a unified Civil procedural code of the Russian Federation determines the list of the most important issues that should be addressed by the legislator when adopting the new Civil procedural code of the Russian Federation.
